Introduction / Scope of This Policy

Northwest Multiple Listing Service (“NWMLS” or “We”) respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information NWMLS may collect from you or that you may provide, and our practices for collecting, using, maintaining, protecting, or disclosing that information, when you use the NWMLS websites including https://www.nwmls.com or https://www.nwmls.com/homes-for-sale, NWMLS mobile applications, and other NWMLS websites, emails, forms, features and related online services that link to this policy (collectively “Services”).

This Privacy Policy applies to information we collect on or through the Services, in email, text, and other electronic messages between you and the Services, on or through forms on the Services, and when you subscribe to any of our mailing lists or newsletters. It also describes privacy choices and rights that may be available to you under applicable law.

It does not apply to information collected:

  • Through any other means, including on any other website operated by us or any third party, including any real estate firm or broker; or
  • By any third party, including through any application or content that may link to or be accessible from or through the Services.

Agreement to Terms

If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using the Services, you agree to this Privacy Policy and our Terms of Use. If you do not agree with the terms of this Privacy Policy or the Terms of Use, you should discontinue use of the Services without providing us with personal information.

Not Directed to People under the Age of 18

Our Services not intended for people under the age of 18. We do not knowingly collect personal information from individuals under 18. If we learn we have unknowingly collected or received personal information from an individual under the age of 18, we will delete that information.

Information We Collect About You and How We Collect It

We collect several types of information from and about users of our Services, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, and geolocation (“personal information”);
  • About your internet connection, the equipment you use to access our Services, and usage details.

We may collect this information directly from you when you provide it to us; automatically as you navigate through the Services; and from cookies and similar technologies. We do not require you to provide all personal information described in this Privacy Policy to use the Services, but certain functions may not be available if you do not provide information needed for those functions.

Unless expressly stated or separately requested, the Services are not designed to collect sensitive personal information, such as health information, precise geolocation, government identification numbers, financial account credentials, biometric information, or protected classification information. You should not include sensitive personal information in Services forms or communications.

Information You Provide to Us

The information we collect on or through our Services may include:

  • Information that you provide by filling in forms on our Services. We may also ask you for information when you report a problem with our Services. One of the forms on our Services allows you to contact the real estate firm or broker for a property in which you may be interested. You may not include any sensitive personal information (e.g., information about any health conditions) in any of the fields in the form.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your search queries on the Services.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Services, including pages visited, how long you remained on our Services, traffic data, general location data, logs, and other communication data and the resources that you access and use on the Services.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.
  • Information about your device and mobile application use, including device model, operating system, device identifier, mobile carrier, login status, searches and preferences, properties viewed, and inquiries or contacts initiated through the mobile application. If permitted by your device settings, we may also collect location information to provide map, nearby-property, and location-based search features. We use this information to operate, secure, analyze, customize, and improve the Services.

The information we collect automatically may include personal information. The information we collect automatically helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to estimate our audience size and usage patterns, store information about your preferences, speed up your searches, and recognize you when you return to our Services.

Cookies and Similar Technologies

Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. Cookies may be strictly necessary, functional, analytical/performance, or targeting/advertising cookies, depending on the Services functionality and third-party tools used. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Services.

We may use Google Analytics or similar analytics providers, advertising networks, embedded-content providers, or other third-party service providers that use cookies or similar technologies to analyze Services use, improve the Services, and, if applicable, support marketing or targeted advertising.

At this time, we do not recognize automated “do-not-track” browser signals. Where required by applicable law, we will recognize valid Global Privacy Control or other universal opt-out preference signals for the browser or device from which the signal is sent.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Services and its contents to you.
  • In connection with our Listing Search feature, with your consent to center the map presented to your browser’s specific geolocation.
  • To provide you with information, products, or services that you request from us.
  • To respond to inquiries, requests, feedback, and reports of Services problems.
  • To send newsletters, updates, or other communications to which you subscribe or that you otherwise request.
  • To analyze Services use, improve the Services, diagnose issues, maintain security, and develop or improve features.
  • To detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity.
  • To fulfill any other purpose for which you provide it.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
  • To comply with legal requirements and enforce our Terms of Use and other agreements.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To contractors, service providers, processors, vendors, advisors, and other third parties we use to support our business, operate the Services, provide analytics, host content, maintain security, communicate with users, and perform other services on our behalf, provided that such parties are subject to contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, financing, bankruptcy, receivership, or other sale or transfer of some or all of Northwest Multiple Listing Service’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Northwest Multiple Listing Service about our users is among the assets transferred.
  • To a real estate firm or broker when and as you complete a form indicating your interest in a given property and being contacted by the firm or broker for that property. We disclose the completed form to the real estate firm or broker, and no personal information except as on that form.
  • To business partners, collaborators, or other third parties where you direct us to disclose information or where disclosure is necessary to provide the information, product, service, or feature you request.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Use and other agreements.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Northwest Multiple Listing Service, our customers, or others.

Sales, Sharing, and Targeted Advertising

Certain state privacy laws define “sale,” “sharing,” and “targeted advertising” broadly. NWMLS does not sell personal information for money.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Cookies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Marketing communications. If you no longer want to receive newsletters, emails, or other marketing communications from us, you may unsubscribe using the instructions in the communication or contact us using the contact information below. You cannot unsubscribe from certain administrative or service-related communications.
  • We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing, Correcting, and Deleting Your Information

If you have completed and submitted through our Services a form to a real estate firm or broker indicating your interest in a given property, a copy of the submission will not be available in your account. Once the form is submitted to the real estate firm or broker, the information on that form would be subject to the privacy terms of that real estate firm or broker. Accordingly, if you would like that information or to have it corrected or deleted, please contact the applicable real estate firm or broker.

Depending on where you reside and subject to applicable law, you may also have rights to request access to, correction of, deletion of, or portability of personal information that we maintain about you, and to opt out of certain processing activities. To make a request, contact us at communications@nwmls.com with the subject line “Privacy Request” or use any additional request method we make available. We may need to verify your identity before responding to your request.

You may unsubscribe from certain communications or request deletion of your account and associated personal information at any time by contacting us at communications@nwmls.com with the subject line, “Privacy Request”, or using any account deletion feature available through the Services. We will process verified deletion requests in accordance with applicable law, our data retention obligations and our privacy policy.

Additional Disclosures for Residents of California and Certain U.S. States

Residents of California and other states with comprehensive consumer privacy laws may have additional rights under applicable law, including the rights to know or access personal information, correct inaccurate personal information, delete personal information, obtain a portable copy of personal information, opt out of sales, sharing, targeted advertising, or certain profiling, limit certain uses or disclosures of sensitive personal information, and be free from unlawful discrimination for exercising privacy rights.

Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected; to comply with legal, regulatory, accounting, contract, audit, or reporting obligations; to resolve disputes; to enforce our agreements; to protect our rights; and as otherwise permitted by law. When personal information is no longer needed, we will delete, de-identify, or destroy it using appropriate security protocols.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These measures may include physical, administrative, and technical safeguards appropriate to the nature of the personal information and the risks associated with processing it. Unfortunately, the transmission of information via the internet is not completely secure. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Links to Other Websites

The Services may link to third-party websites, applications, services, or content, including websites of real estate firms, brokers, service providers, or business partners. We do not control those third parties and are not responsible for their privacy practices, content, or data collection practices. We encourage you to review the privacy policies of any third-party sites or services before providing information to them.

International Personal Information Transfers

NWMLS is located in the United States, and personal information we collect may be processed and stored in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, processed in, and stored in the United States, where privacy laws may differ from those in your jurisdiction. Where required, we use appropriate safeguards for cross-border transfers.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for reviewing this privacy policy for any changes when you visit the Services. If we make material changes, we may provide additional notice through the Services or other appropriate means.
